Abstract

The researcher addressed the international legal protection of Palestinian prisoners and detainees in Israeli prisons as an important topic at the national and international levels. The researcher used the analytical descriptive approach and reached a number of conclusions, perhaps the most important of which was that the legal situation of Palestinians in occupation prisons was prisoners and detainees. Adapting Israeli violations of prisoners' and detainees' rights to war crimes and crimes against humanity. Israel is asked as a subject of international law and Israeli criminals about serious international crimes against prisoners and detainees as well.

The researcher recommends that the International Red Cross (ICRC), as an observer of the application of international humanitarian law, renounce its neutrality and the role of spectator of violations of international humanitarian law and move to the role of exercising efforts and pressuring the occupying Power to put an end to such violations. To call upon the State of Palestine to request the General Assembly of the United Nations to request an advisory opinion from the International Court of Justice concerning prisoners and detainees in occupation prisons, as they have legal and political implications for the situation of prisoners and detainees; Call upon the State of Palestine to initiate international criminal proceedings for international crimes against prisoners and detainees before the International Criminal Court as soon as possible.
